Trump 2024 Hurdles: 14th Amendment; Four Indictments & Project 2025 Plan

Again a very long post taken from an extract from this U.S. NEWS AND WORLD REPORT article for dumb man who ignores and knows nothing about the law, the constitution, or the function of our national government. The article headline:

“Trump Condemns Efforts to Remove Him from the Ballot Under Insurrection Clause”

The former president, who faces trial for attempts to overturn Joe Biden’s 2020 presidential win, ominously warned that 2024 could be the last U.S. election if he is disqualified.

This part is the craziest statement ever made by Donald J. Trump in his most-recent fund-raising email:If crooked Joe and the Democrats get away with removing my name from the ballot then there will never be a free election in America again. We will have become a dictatorship where your president is chosen for you. You will no longer have a vote, or certainly won't have a meaningful vote.”

Trump’s remarks come on the fourth day of a hearing in Denver, where legal experts and scholars have been sparring over whether the January 6, 2021, riot at the Capitol qualified as an insurrection and whether Trump’s actions: Including pressuring state officials to reverse the election results (the “fake electors” scheme) and telling armed supporters ahead of the riot on that fateful day: “to fight like hell” (or lose their country), while encouraging them to go march on the Capitol – should and must disqualify him from ever running for president in 2024 again, under the provisions of Section 3 of the 14th Amendment.

That provision simply states: No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

Now a flurry of lawsuits in Colorado, Minnesota, Michigan, Arizona, New Hampshire, and New Jersey are testing that section of the amendment and whether it disqualifies Trump from ever running for president again, given his involvement in the violent insurrection at the Capitol on January 6, 2021.

He also included this brief statement in a video to his MAGA base: It may also be the last election we ever have if this election doesn't work. If this election is rigged and stolen, if bad things happen, our country will not survive. We must win in 2024. If we don’t win, we will not have a country.”

It states in part that he, and he alone, can be, must be, and will be America’s first and only dictator and not anyone else – never, ever again, and that new provision extends to his family, too.

Report here from The AP (extracted key parts below)  vis-à-vis Trump’s “Revenge Tour 2024” – that is his campaign plan to get back in the W/H as conservative groups and others drew up a plan to dismantle the Federal government and replace it with Trump’s version in the document that is called: “Project 2025.

Highlights & Impact: With more than a year to go before the 2024 election, a constellation of conservative organizations is preparing for a possible second White House term for Trump. 

They are recruiting thousands to come to Washington on a mission to dismantle the Federal government and replace it with his vision of government that is simple: A one-man rule.

In the nearly 1,000-page “Project 2025” handbook he has an army of followers ready to go to work on day one to commandeer, reshape, and do away with what Republicans deride as the “Deep State” bureaucracy, in part by firing as many as 50,000 federal workers and then a lot more.

Specifics of Trump’s power grab: Trump’s top allies are preparing to radically purge potentially thousands of civil servants and filling career posts with loyalists to him and his “American First” ideology.

The impact could go well beyond typical conservative targets such as: The EPA; IRS; the DOJ by stripping layers therein and potentially including the FBI, and also reaching into national security, intelligence, the State Department, and the Pentagon as he often complains and calls them “The Deep State.”

The centerpiece and background of Trump 2025: Trump, in October 2020, signed an EO creating “Schedule F in the Excepted Service,” which established a new employment category for federal employees. It received wide media coverage for a short period, then was largely forgotten in the mayhem and aftermath of January 6, and then quickly rescinded by President Biden. 

Now sources close to Trump say that if he were reelected to a second term, he would immediately re-impose Schedule F.

How that part would work: Tens of thousands of civil servants who serve in roles deemed to have some influence over policy would be reassigned as “Schedule F” employees. Upon reassignment, they would lose their employment protections.

FYI: Newly-elected presidents replace more than 4,000 “political appointees to oversee the running of department in the new administration.” 

Below that rotating layer of political appointees sits a mass of government workers who enjoy strong employment protections under civil service rules — and they typically continue their service from one administration to the next, regardless of the president’s party affiliation.

An initial estimate by the Trump official who came up with Schedule F found it could apply to as many as 50,000 federal workers — a fraction of a workforce of more than 2 million, but a segment with a profound role in shaping American life.

Therefore in theory, Trump could fire tens of thousands of career government officials with no recourse for appeals and replace them with people he believes are more loyal to him and to his plans for “America First.”

That would create a significant chilling effect on government employees all across government with a very bad effect, and it would effectively upend the modern civil service system, triggering a shock wave across the bureaucracy and be very harmful.

Historical note: The first state civil service law was enacted under then NY Assemblyman Theodore Roosevelt and then NY Governor Grover Cleveland in 1883. Teddy also served as a commissioner on the U.S. Civil Service Commission, and he was a staunch supporter of civil service leading to a period of major government expansion and further reforms of the civil service system. He is known as the “Father of civil service.”

Such pendulum swings and politicization under Trump would threaten the continuity and quality of service to taxpayers, the regulatory protections, the checks on executive power, and other aspects of American democracy.

Trump allies claim such pendulum swings will not happen because they will not have to fire anything close to 50,000 federal workers to achieve the result, as one source put it, of “behavior change.”

How that would work: Firing a smaller segment of “bad apples” among the career officials at each agency would have the desired chilling effect on others tempted to obstruct Trump’s orders.

They say Schedule F will finally end the “farce of a nonpartisan civil service that they say has been filled with activist liberals who have been undermining GOP presidents for decades.

Unions and Democrats would be expected to immediately fight a Schedule F order. But Trump’s advisers like their chances in a judicial system now dominated at its highest levels by conservatives.

Finally, I would add to this post, please work hard to help get out the vote to ensure that Trump or anyone like him never wins and that assumes the worst happens and Trump were to get on the 2024 ballot. I shudder to think of that outcome - do you?
